Capital Punishment

Pā‘ao (ca 1300,) from Kahiki (Tahiti,) is reported to have introduced (or significantly expanded) a religious and political code in old Hawai‘i, collectively called the kapu system.

The kapu system was the common structure, the rule of order, and religious and political code.  This social and political structure gave leaders absolute rule and authority.   This forbid many things and demanded many more, with many infractions being punishable by death.

Shortly after the death of Kamehameha I in 1819, King Kamehameha II (Liholiho) declared an end to the kapu system.  In a dramatic and highly symbolic event, Kamehameha II ate and drank with women, thereby breaking the important eating kapu.

This changed the course of the civilization and ended the kapu system, effectively weakened belief in the power of the gods and the inevitability of divine punishment for those who opposed them.  The end of the kapu system by Liholiho happened before the arrival of the missionaries; it made way for the transformation to Christianity and westernization.

While Liholiho’s brother Kauikeaouli (Kamehameha III) ruled as monarch (with shared authority with the Kuhina Nui,) he, too, took bold steps in changing the structure of governance.  Kamehameha III initiated and implemented Hawaiʻi’s first constitution (1840) (one of five constitutions governing the Islands – and then, later, governance as part of the United States.)

Included were also published “penal laws,” which outlined classes of offenses and punishments for the same – with the death penalty being allowed for acts of murder.

“Many foreigners had predicted that whenever it became necessary to enforce the Penal Laws this enacted and promulgated, leniency would be shown towards chiefs of high rank.”  (Bennet)

Then, there was enforcement and execution of the new laws on someone of rank, Kamanawa II (his father was High Chief Kepoʻokalani.)

Kamanawa, born during the days of the ancient customs with an unstructured approach to marriage, had found it difficult to live according to the increasingly Christian ways of his peers. When “one-to-one” marriage had been declared the law by royal order, his roving habits were not changed, and whenever he was attracted to a new love he followed his old ways. Kamokuiki (his wife,) adhering to the new faith, had little sympathy with his wanderings and finally went to the chiefs seeking a divorce.  (Gutmanis)

As early as 1825, the chiefs in various districts had issued edicts of law that, following Christian teachings, included prohibitions against adultery and the biblical relief of divorce and the right to remarry given the injured party. And so it was with Kamokuiki whose divorce, dated August 16, 1840, stated: because Kamanawa has repeatedly committed adultery, his wife Kamokuiki has requested a separation.  (Gutmanis)

There is no record of how Kamanawa received the decree, but six weeks later on September 26, 1840 Kamokuiki was dead. Murder being instantly suspected, an autopsy was performed and the stomach found to be “much inflamed while every thing else was in order.”  (Gutmanis)

Kamanawa and his friend Lonopuakau, captain of the Hawaiian vessel Hooikaika, confessed that Kamanawa had administered the fatal dose and that the Captain had prepared the mixture of ʻakia, ʻauhuhu and ʻawa that caused Kamokuiki’s death.

“She survived but three hours, medical assistance being of no avail. As soon as she was dead, which was about midnight, the news immediately spread and a terrible wailing commenced, which was quickly born to the other side of the island. It was so loud, so prolonged and so sudden as to awake at once almost all the residents, and at that hour, as its sepulchral cadences rose and fell, and were lost in the distance, the effect was startling and mournful in the extreme.”   (Hawaiian Gazette, October 12, 1894)

Justice was swift; on September 30, 1840, a jury of 12 chiefs was empaneled to try Kamanawa and Lonopuakau.

On “Wednesday morning a court was held at the Fort, for the trial of Kamanawa and Lono, captain of the schooner Hooikaika, for the murder of Kamokuiki, wife of the former.  Governor Kekūanāoʻa was the presiding Judge, the King and high chiefs being present.”  (The Polynesian, October 3, 1840)

“The court being organized, the trial commenced, when the following facts were developed: The first-mentioned person, it appears, had been divorced from his wife for some time past, but could not marry again while she was living: Having conceived a violent passion for another woman, he determined to rid himself of his wife, and applied to Lono, who was said to be skilled in preparing poisons. Lono also wishing to destroy his wife, the two agreed to poison both”.  (The Polynesian, October 3, 1840)

The jury found the two guilty and sentenced to hang on October 20th.

On the October 24, The Polynesian carried a short item that succinctly summed up the execution of the sentencing: “The murderers Kamanawa and Lonopuakau expiated their crime on the scaffold on Tuesday last, at the Fort in the presence of a large concourse of people.”

The site of the execution was over the gate of Fort Kekuanohu (Fort Honolulu – that once stood at the bottom of Fort Street;) the gallows was erected above the gate, so it could be easily seen for some distance.

After the hanging, either one or both of the bodies were buried at the cross-roads, in accordance with the old English custom of burying executed criminals where they would be out of the way, and the burial places be forever unknown. It is believed that the cross roads selected were at the junction of King and Punchbowl or Queen and Punchbowl streets.

I should note – Kamanawa II was no ‘ordinary’ ranking chief.

He was the grandson of Kameʻeiamoku, one of the ‘royal twins’ (uncles of Kamehameha the Great and his counselors in the wars to unite the Islands.) He was named after his famous grand uncle, the other royal twin.  (The twins are on Hawaiʻi’s Royal Coat of Arms; Kameʻeiamoku is on the right holding a kahili and Kamanawa on the left holding a spear.)

Oh, one more thing … Kamanawa II and Kamokuiki were parents of Caesar Kapaʻakea.  In 1835, Caesar married the High Chiefess Analeʻa Keohokālole; they had several children.

Most notable were a son, who on February 13, 1874 became King Kalākaua, and a daughter, who on January 29, 1891 became Queen Liliʻuokalani (they were grandchildren of Kamanawa II, the first to be charged and hanged under Hawaiʻi’s first modern criminal laws.)

It is said that after Kalākaua came to the throne, he had the body of Kamanawa taken up and the bones removed to Mauna Ala in Nuʻuanu. This is positively stated by the natives.  (Hawaiian Gazette, October 12, 1894)  Kamokuiki was buried at Kawaiahaʻo Church.

Liliʻuokalani

At that time she was born, children often were named in commemoration of an event. She was given the name Lydia Liliʻu Loloku Walania Wewehi Kamakaʻeha.

Kuhina Nui Kīnaʻu had developed an eye infection at the time of Liliʻu’s birth. She gave the child the names Liliʻu (smarting,) Loloku (tearful,) Walania (a burning pain) and Kamakaʻeha (sore eyes.)

“Very near to (the site of Queen’s Hospital,) on Sept. 2, 1838, I was born. My father’s name was Kapaʻakea, and my mother was Keohokālole; the latter was one of the fifteen counsellors of the king, Kamehameha III., who in 1840 gave the first written constitution to the Hawaiian people.”

“My great-grandfather, Keawe-a-Heulu, the founder of the dynasty of the Kamehamehas, and Keōua, father of Kamehameha I., were own cousins, and my great-grandaunt was the celebrated Queen Kapiʻolani, one of the first converts to Christianity. “

“She plucked the sacred berries from the borders of the volcano, descended to the boiling lava, and there, while singing Christian hymns, threw them into the lake of fire.”

“This was the act which broke forever the power of Pele, the fire-goddess, over the hearts of her people. Those interested in genealogies are referred to the tables at the close of this volume, which show the descent of our family from the highest chiefs of ancient days.”

“But I was destined to grow up away from the house of my parents.” (Lili‘uokalani)

As was the custom, Liliʻu was hānai (adopted) to Abner Pākī and his wife Laura Kōnia (granddaughter of Kamehameha I), who reared her with their birth daughter, Pauahi (born December 19, 1831).

“When I was taken from my own parents and adopted by Paki and Konia, or about two months thereafter, a child was born to Kīna‘u. That little babe was the Princess Victoria, two of whose brothers became sovereigns of the Hawaiian people.”

“While the infant was at its mother’s breast, Kīna‘u always preferred to take me into her arms to nurse, and would hand her own child to the woman attendant who was there for that purpose.”

“I knew no other father or mother than my foster-parents, no other sister than Bernice. I used to climb up on the knees of Paki, put my arms around his neck, kiss him, and he caressed me as a father would his child …”

“… while on the contrary, when I met my own parents, it was with perhaps more of interest, yet always with the demeanor I would have shown to any strangers who noticed me.”

“My own father and mother had other children, ten in all, the most of them being adopted into other chiefs’ families; and although I knew that these were my own brothers and sisters, yet we met throughout my younger life as though we had not known our common parentage. This was, and indeed is, in accordance with Hawaiian customs.” (Lili‘uokalani)

Lili‘uokalani lived on the property called Haleʻākala, in the house that Pākī built on King Street. It was the ‘Pink House,’ made from coral (the house was name ʻAikupika (Egypt.)) (It is not clear where the ʻAikupika name came from.)

The two-story coral house was built by Pākī himself, from the original grass hut complex of the same name at the same site; he financed the construction through the sale of Mākaha Valley (ʻAikupika would later become the primary residence of his daughter Bernice Pauahi and her husband, Charles Reed Bishop.)

“At the age of four years I was sent to what was then known as the Royal School, because its pupils were exclusively persons whose claims to the throne were acknowledged. It was founded and conducted by Mr Amos S Cooke, who was assisted by his wife.”

“It was a boarding-school, the pupils being allowed to return to their homes during vacation time, as well as for an occasional Sunday during the term.”

“I was a studious girl; and the acquisition of knowledge has been a passion with me during my whole life, one which has not lost its charm to the present day. In this respect I was quite different from my sister Bernice.” (Lili‘uokalani)

Founded in 1839 during the reign of King Kamehameha III, the original Chief’s Children’s School was in the area where the ʻIolani barracks now stand.

Mr. and Mrs. Amos Cooke, missionaries from New England, were commissioned to teach the 16 royal children (others who joined the Pākī sisters were Lot Kapuāiwa (later Kamehameha V), Queen Emma, King William Lunalilo and Liliʻu’s brother, David (later King Kalākaua.)

In 1846 the school’s name was officially changed to Royal School; attendance was restricted to descendants of the royal line and heirs of the chiefs. In 1850, a second school was built on the site of the present Royal School; it was opened to the general public in 1851.

Fast forward … on the afternoon of January 16, 1893, 162 sailors and Marines aboard the USS Boston in Honolulu Harbor came ashore. The home that Liliʻuokalani was raised in (later known as Arlington Hotel) served as the headquarters for the USS Boston’s landing force (Camp Boston) at the time of the overthrow of the Hawaiian monarchy, January 17, 1893.

Puʻu ʻOhau

Fishers generally refer to it as ‘Red Hill;’ its volcanic cinder, partially collapsed and exposed on the seaward side, gives it an easy name.  It’s not just a marker; fishers troll offshore with great success.

Nearshore is a marine fisheries management area; you can catch fish for personal consumption, but there is no aquarium fish collection permitted.

The hill is actually named Puʻu ʻOhau (hill of dew) and is the most conspicuous coastal landmark on the low coastal cliffs between Keauhou Bay (to the north) and Kealakekua (on the south;) it marks the boundary between North and South Kona.

Although the entire landform may be the “puʻu,” according to McCoy … the archaeological evidence tends to indicate that the area was used for general habitation purposes and was not reserved for only burial or other ritual uses that might be considered exclusionary.

This archaeological evidence suggests that there may have been a land use distinction between the flat bench and the steeper slopes of the puʻu although they are part of the same landform.

The matter of a burial on the puʻu helps us remember some others.

With the recent construction and extension of the Ane Keohokālole Highway from Palani road to Hina Lani, many in West Hawaii (although they generally reference the road as “Ane K”) are becoming more familiar with the name Keohokālole.

Analeʻa, Ane or Annie Keohokālole was a Hawaiian chiefess; she was born at Kailua-Kona, Hawaiʻi in 1816.  Through her father, she was descended from Kameʻeiamoku and Keaweaheulu, two of the four Kona Uncles that supported Kamehameha I.

Her first marriage was to John Adams Kuakini; they had no children.  Kuakini was an important adviser to Kamehameha I in the early stages of the Kingdom of Hawai‘i.

When the Kingdom’s central government moved to Lāhainā in 1820, Kuakini’s influence expanded on Hawaiʻi Island, with his appointment as the Royal Governor of Hawaiʻi Island, serving from 1820 until his death in 1844.

During his tenure, Kuakini built some of the historical sites that dominate Kailua today.  The Great Wall of Kuakini, probably a major enhancement of an earlier wall, was one of these.

The Great Wall of Kuakini extends in a north-south direction for approximately 6 miles from Kailua to near Keauhou, and is generally 4 to 6-feet high and 4-feet wide;’ the Great Wall of Kuakini separated the coastal lands from the inland pasture lands.

Speculation has ranged from military/defense to the confinement of grazing animals; however, most seem to agree it served as a cattle wall, keeping the troublesome cattle from wandering through the fields and houses of Kailua.

Kuakini also built Huliheʻe Palace; it was completed in 1838, a year after the completion of Mokuʻaikaua Church (Lit., section won (during) war,) the first stone church on the Island of Hawaiʻi.

In 1833, Analeʻa married Caesar Kapaʻakea, a chief of lesser rank and her first cousin. Caesar’s father, Kamanawa II was no ‘ordinary’ ranking chief; he was the grandson of Kameʻeiamoku, one of the ‘royal twins.’

He was named after his famous grand uncle, the other royal twin.  (The twins are on Hawaiʻi’s Royal Coat of Arms; Kameʻeiamoku is on the right holding a kahili and Kamanawa on the left holding a spear.)

Caesar’s father has one other notable distinction; he was found guilty of poisoning his wife (Caesar’s mother) and was the first to be hanged for murder under the newly formed constitution and penal laws (1840.)

OK, back to Caesar and Analeʻa – they had several children.  Most notable were a son, who on February 13, 1874 became King Kalākaua, and a daughter, who on January 29, 1891 became Queen Liliʻuokalani – the Kalākaua Dynasty that ruled Hawaiʻi from 1874 to 1893.

Oh, the burial at Puʻu ʻOhau?  Ane Keohokālole’s mother, Kamaeokalani (Kamae) is buried at its top.

When I was at DLNR, the matter of dealing with the burial came up within the first few days of my term (in 2003.)  Back in 1999, members of the ʻOhana Keohokālole requested that protective measures be put in place on the puʻu.

The matter was on the Hawaiʻi Island Burial Council’s agenda; the family’s suggested means of protection is the construction of a six (6) foot rock wall around Puʻu ʻOhau.  After talking with family members, it was decided to order the wall to be placed on the 120-foot contour.

Kapaʻakea Spring

It was once a perched water-table pond and spring.

It was originally known as Kumulae Spring (Pond – also Kapaʻakea and later Hausten Spring/Pond) and was reportedly the property of Kamāmalu (sister of Kamehameha IV and V.)  She and her brothers loved swimming in the pond; they and others shared food and drinks there.

The spring is the subject of an old legend that tells of a wondrous princess upon whom men’s eyes were forbidden to gaze.  The princess loved the waters of the spring and from time to time she would go there at night and bathe.  In time, the waters of the spring became known for its healing powers.  (Kanahele)

As in much of Oʻahu, geologically, the bedrock is actually reef limestone.  Lava from the upslope Sugarloaf covered the limestone and cooled (with a thickness of about 40-feet.) After cooling of the Sugarloaf lava, alluvium and marshy lagoon sediments accumulated atop much of the limestone.  A few inches of soil covered the top.  (Halliday)

Groundwater flow cut through the limestone forming a karstic drainage system (Karst being a geological formation shaped by the dissolution of a layer or layers of soluble bedrock, such as limestone.)   This region, in and around the lower portions of the University of Hawaiʻi, became part of the Mōʻiliʻili Karst.   Caverns and perched water-table springs and ponds were exposed at the surface.

The best-known of theses ponds was Kumulae.  By the early-1920s, Mr. Hausten purchased and cleared the land, and stocked the pond with koi which interbred with existing fish.   The large clear fishpond quickly became a noted attraction.

It was the family’s garden home with beautiful tropical gardens of flora and fauna.  Emma McGuire “Ma” Hausten was an avid gardener and planted white ginger, water lilies, plumeria from the South Seas, willow trees, kukui trees, breadfruit and fruit trees as well as Hawaiian herbs and medical plants.

The gardens thrived and people asked if they might use the tropical setting for weddings, luaus and parties.  Finally, in the mid-1930s limited private parties were held.  (Willows)

Then, ‘tragedy’ happened.  In the autumn of 1934, the Hausten pond disappeared without warning, draining in less than 24 hours.

It turns out, construction activities downslope from the King-University intersection struck a master conduit in the underground watered cave system.   Water drained out.  Upslope, the results of this dewatering were dramatic.

The master conduit was eventually resealed, the cave’s water table temporarily recharged, but the karst was never the same again.  There have been several instances of collapses since the dewatering. One instance in 1952 involves the Standard Trading store falling through the ground into the karst below it.  Another instance involves the emergence of a large cavern downslope from the King-University intersection.

During World War II, times were tough.  An offer was made for the property; but instead of selling, the family decided to serve light lunches and drinks. In 1944, the Willows Restaurant opened as a club by Emma’s daughter, Kathleen Perry, along with husband Al (30-year musical director of Hawaii Calls,) her brothers Allan and Walter McGuire and other family members.  Together, they presided over a gracious era of Hawaiian music and hospitality during the late-1940s and 1950s.  (Willows)

But after the dewatering, the historic pond was never the same, the continuing drop in the water table especially impacted the Willows Restaurant. The willow trees wilted and the restaurant lost its attractiveness and its customers.

New sinkholes developed. “People living in the vicinity made their way into the caves through holes in their yards and speared fish by the hundreds.”  Several houses “lurched” and settled.  Sidewalks cracked and water and gas mains ruptured. Some trees sank almost 3-feet.  (Halliday)

The spring dried up and a remnant of the pond had to be lined with concrete.  A manmade water feature surrounded by rock and plants has been built to recreate the ambience of the old days.

In 1998, the site was sold and restored.  The Willows re-opened its doors on the threshold of a new millennium in 1999, after six years of being closed.

King Kalākaua

David Laʻamea Kamanakapuʻu Mahinulani Nalaiaehuokalani Lumialani Kalākaua was born in Honolulu to High Chief Kahana Kapaʻakea and the High Chiefess Analea Keohokālole, on November 16, 1836.

Per the custom of the times, he was hānai (adopted) by the chiefess Haʻaheo Kaniu, who took him to Maui, where the court of King Kamehameha III was located. When Kalākaua was four, he returned to Oʻahu to begin his education at the Royal School.

There, he became fluent in English and the Hawaiian language.  At 16, he began studying law (although his obligations and positions he held prevented him from fully completing his legal training.)

By 1856, Kalākaua was on the staff of King Kamehameha IV.  In addition to his military duties, Kalākaua served in the Department of the Interior; in 1863, he was appointed postmaster general.

In December 1872, King Kamehameha V died without designating an heir and per the law, an election was held to determine his successor.   Kalākaua made his first bid for Hawaiʻi’s throne in 1873.

The kingdom’s Constitution stated if the monarch dies before naming a successor “such vacancy, shall cause a meeting of the Legislative Assembly, who shall elect by ballot some native Alii of the Kingdom as Successor”.

They were presented with two choices: Kalākaua, who ran on a campaign slogan of “Hawaii for Hawaiians” and William C. Lunalilo.

Lunalilo won; but he died a year later, leaving no successor. On February 12, 1874, nine days after the passing of King Lunalilo, an election was held between the repeat candidate David Kalākaua and Queen Emma – widow of King Kamehameha IV.  Kalākaua won.

The triumphant Kalākaua toured the islands, stopping in every district to affirm his primary goals. “To the planters, he affirmed that his primary goal was the advance of commerce and agriculture, and that he was about to go in person to the United States to push for a reciprocity treaty. To his own people, he promised renewal of Hawaiian culture and the restoration of their franchise.” (Tabrah)

The Treaty of Reciprocity-1875 between the US and the Kingdom of Hawai‘i eliminated the major trade barrier to Hawai‘i’s closest and major market.  Through the treaty, the US gained Pearl Harbor and Hawai‘i’s sugar (and other) planters received duty-free entry into US markets.

Under Kalākaua’s direction, the cornerstone for ʻIolani Palace was laid on December 31, 1879.  Construction was completed in 1882; in December of that year Kalākaua moved into his palace with his wife, Queen Kapi’olani, the granddaughter of King Kaumuali’i of Kauaʻi.

Kalākaua was the first Hawaiʻi sovereign to visit the United States, as well as circumnavigate the globe (he did that twice.)   His travels were to study the matter of immigration and to improve foreign relations. He also wanted to study how other rulers ruled.

He sought closer ties with Japan, and in 1883, Kapena (selected for the diplomatic mission to Japan) delivered a speech in Tokyo in which he declared that “His Majesty [Kalākaua] believes that the Japanese and Hawaiian spring from one cognate race and this enhances his love for you.”  (Kuykendall)

” … Hawaii holds out her loving hand and heart to Japan and desires that your people may come and cast in their lots with ours and repeople our Island Home with a race which may blend with ours and produce a new and vigorous nation.”  (Kuykendall)

Kalākaua had a passion for music, dancing, parties and the finest food and drinks and he lived up to the title of Merrie Monarch (a reference some suggest is linked to the nickname given to Charles II of England, who ruled (and partied) in the mid-1600s.)

His friend, Robert Louis Stevenson described Kalākaua as “a cultured intellectual of unusual mental powers.” A poet and lyricist, athlete and consummate politician, he was responsible for initiating the resurgence of Hawaiian cultural arts, particularly hula.

Kalākaua was a staunch supporter of native Hawaiian civil rights.  In part, this led to a rebellion in 1887 forcing him to sign a new constitution relinquishing his powers as head of state and relegated him to a figurehead; it also imposed a fairly high property ownership qualification on those running for the new legislature.  This new constitution became known as the Bayonet Constitution.

Two years later, Kalākaua retired to Waikīkī.  His health began to fail by 1890 and under the advice of his physician he traveled to San Francisco, where he was given a warm welcome. “A title was a title, and (the Americans) enjoyed him as a personality.” (Tabrah))

He died on January 20, 1891, at the age 54, at the Palace Hotel in San Francisco.  Kalākaua, Hawaiʻi’s last King, is said to have uttered his last words: “Tell my people I tried.”

Because he and his wife Queen Kapiʻolani did not have any children, his sister, Liliʻuokalani succeeded him to the Hawaiian throne.   (Kalākaua was known as a Renaissance Man and into technology – those are the subjects of future stories.)  I have added other images of Kalākaua in a folder of like name in the Photos section on my Facebook page.
