Two Wills, Two Outcomes

Prince Lunalilo was born on January 31, 1835 to High Chiefess Miriam ‘Auhea Kekauluohi (Kuhina Nui, or Premier of the Hawaiian Kingdom and niece of Kamehameha I) and High Chief Charles Kanaʻina.

Lunalilo’s grandparents were Kalaʻimamahu (half brother of Kamehameha I) and Kalākua (sister to Kaʻahumanu). His great grandfather was Keōuakupupailaninui (Keōua, father of Kamehameha I.)

Lunalilo was educated at the Chiefs’ Children’s School, and at age four, became one of its first students. He was known as a scholar, a poet and a student with amazing memory for detail.

From a very young age, he loved to write with favorite subjects in school being literature and music. He composed Hawai’i’s first national anthem, E Ola Ke Ali`i Akua, or God Save the King.

He also developed a sense of justice and love for people. These traits were recognized by the age of six in the unselfish and caring manner in which he interacted with his servants.

As a young man, he was courteous and intelligent, generous and friendly. His close friends affectionately called him “Prince Bill”. His native people called him ”Lokomaikaʻi”, meaning “generous or benevolent”.

When Lunalilo died in 1874, while he was king, he was the first of the large landholding aliʻi to create a charitable trust for the benefit of his people.

His estate included large landholdings on the five major islands, consisting of 33-ahupuaʻa, nine ʻili and more than a dozen home lots. His will, written in 1871, established a perpetual trust under the administration of three trustees to be appointed by the justices of the Hawaiian Supreme Court.

The purpose of the trust was to build a home to accommodate the poor, destitute and infirm people of Hawaiian (aboriginal) blood or extraction, with preference given to older people. The will charged the Trustees to sell all of the estate’s land to build and maintain the home.

His will states “all of the real estate of which I may die seized and possessed to three persons … to be held by them in trust for the following purposes, to wit …”

“… to sell and dispose of the said real estate to the best advantage at public or private sale and to invest the proceeds in some secure manner until the aggregate sum shall amount to $25,000, or until the sum realized by the said trustees shall with donations or contributions from other sources, amount to the said sum of $25,000.” (District Court Records)

“The will leaves the testator’s real estate to his Trustees in trust to sell the same at public or private sale and invest the same till the amount realized from such sale or by additions from other sources shall be $25,000 …”

“… and then directs that they shall expend the whole amount in the purchase of land and in the erection of a building or buildings on the Island of Oahu for specified eleemosynary purposes.” (Supreme Court Records)

His will notes, “Then I order the trustees to exceed the whole amount in the purchase of land and in the erection of a building or buildings on the Island of Oʻahu, of iron, stone, brick or other fireproof material, for the use and accommodation of poor, destitute and infirm people of Hawaiian blood or extraction, giving preference to old people.” (District Court Records)

According to the instructions in the will, the Estate trustees sold the land, built Lunalilo Home and invested the remaining proceeds in mortgages, securities and government bonds.

Unfortunately, those investments went sour, and today the Lunalilo estate has limited assets, other than Lunalilo Home in Hawaiʻi Kai and the land under it, and the trust must constantly raise funds to maintain the operation of the home. (Byrd)

Reportedly, Lunalilo left an estate even larger than the one left by Princess Bernice Pauahi Bishop, founder of Kamehameha Schools. However, the outcome of her estate has had a different ending.

High Chief Abner Pākī and his wife High Chiefess Laura Kōnia (Kamehameha III’s niece) had one child, a daughter, Bernice Pauahi Pākī (born December 19, 1831.)

When her cousin, Princess Ruth Keʻelikōlani, died, Keʻelikōlani’s will stated that she “give and bequeath forever to my beloved younger sister (cousin), Bernice Pauahi Bishop, all of my property, the real property and personal property from Hawaiʻi to Kauaʻi, all of said property to be hers (about 353,000 acres.)”

(Keʻelikōlani had previously inherited all of the substantial landholdings of the Kamehameha dynasty from her brother, Lot Kapuāiwa (King Kamehameha V.))

Pauahi died childless on October 16, 1884. Her will formed and funded the Kamehameha Schools; “I give, devise and bequeath all of the rest, residue and remainder of my estate real and personal … to erect and maintain in the Hawaiian Islands two schools, each for boarding and day scholars, one for boys and one for girls, to be known as, and called the Kamehameha Schools.”

Bernice Pauahi Bishop’s will (Clause 13) states her desire that her trustees “provide first and chiefly a good education in the common English branches, and also instruction in morals and in such useful knowledge as may tend to make good and industrious men and women”.

That same Clause gives the “trustees full power to make all such rules and regulations as they may deem necessary for the government of said schools and to regulate the admission of pupils, and the same to alter, amend and publish upon a vote of a majority of said trustees.”

She directed “that the teachers of said schools shall forever be persons of the Protestant religion, but I do not intend that the choice should be restricted to persons of any particular sect of Protestants.”

However, in order to support her vision, her will did not require her trustees to sell the land; rather, they can only sell “for the best interest” of the estate. Clause Seventeen notes, “I give unto the trustees … the most ample power to sell and dispose of any lands or other portion of my estate, and to exchange lands and otherwise dispose of the same … “

“I further direct that my said trustees shall not sell any real estate, cattle ranches, or other property, but to continue and manage the same, unless in their opinion a sale may be necessary for the establishment or maintenance of said schools, or for the best interest of my estate.”

Today, the Kamehameha Schools Bishop Estate has net assets of nearly $7-billion and annual operating revenue of $1.34-billion.

“Had Lunalilo directed its trustees, as Princess Pauahi Bishop did, to retain the land and sell it only as necessary to run the home for the aged, the Lunalilo Trust today would rival the Bishop Estate in its net asset value, and it would be able to assist many more than the approximately fifty elderly Hawaiians who now live in Lunalilo Home.” (Takabuki)

“Princess Pauahi was wise when she directed her trustees to retain the “ʻĀina,” her primary endowment, and sell it only when necessary for the Kamehameha Schools or the best interest of the trust. Real estate has been, and will continue to be, a sound, prudent, long-term investment.” (Takabuki)

This summary is intended to address one key differing statement in the respective wills. While each called for trustees selected by the Supreme Court (thereby not knowing who would eventually carry out its instruction,) Lunalilo instructed his trustees to sell his land; on the other hand, Pauahi gave her trustees that right, but only in the “best interest” of the trust.

Kapiʻolani Maternity Home

“The Hui Hoʻolulu a Ho‘ola Lahui of Kalākaua I was organized at Kawaiahaʻo, Her Royal Highness Princess Kapili Likelike being President. … A large number of members joined the Society on this day, some 51. The amount of money collected was $17.00, the dues being ten cents per month.” (Report of the Executive Committee, February 19, 1874)

“His Majesty Kalākaua designed and established an organization for benevolent work amongst his people; it was called the Ho‘oululahui. The first meeting of the society having been appointed at Kawaiahaʻo Church, there was a good attendance of the first ladies of the city, not only those of Hawaiian families, but also of foreign birth.”

“It was my brother’s intention that the society should have as its head Her Majesty Kapiʻolani, his queen … Like many other enterprises of charity, the original intentions of the founders have been improved upon; and the society is merged in other good works, or its purposes diverted to slightly different ends. The organization is now consolidated in the Maternity Home …” (Liliʻuokalani)

Attending Queen Victoria’s Jubilee celebration, 1887, in London, Kapiʻolani made many visits to hospitals and foundling homes and returned to Hawaiʻi with much enthusiasm and exciting plans for her hospital. She wanted to establish a hospital for underprivileged Hawaiian women to have the best care for mothers and babies.

“The Kapiʻolani Maternity Home, corner of Beretania and Makiki Sts, was opened to the public on Saturday afternoon (June 14, 1890) their Majesties the King and Queen drove up to the home punctually at 3 o’clock”.

“Quite a large number of ladies were out to inspect the Home, the lady board of managers taking particular pains to shew them round. It is to be hoped that this beautiful new home will be largely availed of by Hawaiians.”

“There are five bedrooms, one furnished by Mrs TR Foster, one each by the Widemann and Robinson families, one by Mrs Canavarro and Mrs JI Dowsett, and one by Mrs S Parker, Mrs TW Everett and Mrs EP Low.”

“They all looked cosy and neat. In the dining room are hung pictures of the King and Queen. There is also a matron’s room and a kitchen with range. Mrs. Johnson has been placed in the home as matron.” (Pacific Commercial Advertiser, June 16, 1890)

“The Ho‘oulu and Ho‘ola Lahui Society, that instituted the Home and appointed a Board of Managers for it, has acquired an endowment fund of $8,000, only the interest of which is available for the Home.”

“Her Majesty gives the house free for the first year, which will expire in four and a half months from date. Dr. Trousseau’s generous tender of free professional services was also for the first year.” (Daily Bulletin, January 22, 1891)

It started in the former residence of Princess Kekaulike, then moved into an adjacent building (former home of August Dreier,) a more spacious 2-story structure. Services included child birthing, as well as simple neo-natal and maternal care. If complications arose, physicians from Queen’s would assist.

“The Home was unique in many regards. First, it represented one prong of the Kalākaua’s’ attempt to deal with the declining population of the native Hawaiians in the kingdom.”

“Second, the Home was established and dominated in its early management by women, And third, in comparison to the other crown-based health entities (Queen’s Hospital, Lunalilo Home and Lili‘uokalani Children’s Center,) the Kapiʻolani Home was least endowed by the mechanism of royal philanthropy.” (Kamakahi)

Fundraising was on going … “The charity luau given on Saturday under the direction of Queen Dowager Kapiʻolani, for the benefit of the Kapiʻolani Maternity Home was an unqualified success in every particular.”

“During the day the ice cream booth was also a small mint, as no young man who possessed fifty cents was allowed to depart without first spending it. … The coffee stand was … assisted by a bevy of young ladies. They all did their share towards the substantial result of the day. … The luau reflects great credit on everybody concerned, and should return a handsome sum for the Kapiʻolani Home. (Pacific Commercial Advertiser, March 7, 1892)

Luau fundraising continued as the facility was expanded, “The trustees of the Kapiʻolani Maternity Home have found it necessary to build an additional wing to the main building to meet the pressing demands and it is intended to hold a luau and fair on the grounds of the Home in the early part of the month of October coming for the purpose of raising additional fund to the already existing building fund of $4,500.” The Independent, August 26, 1903)

By the early-1920s, the Home’s sights were set on the creation of a medical facility with physicians on staff. Rather than compete with other medical institutions (Queen’s, Kuakini, Tripler, St Francis, etc,) in general care, it moved its location, again, and from Home to Hospital status, and changed its name to Kapiʻolani Maternity and Gynecological Hospital in 1931. Across town, Albert and Emma Wilcox purchased land and built a hospital; in 1909, the Kauikeōlani Children’s Hospital opened on Kuakini Street and was named in Emma’s honor. (The deaths of five of her siblings at early ages greatly influenced Emma’s concern for the welfare of all native Hawaiians.)

In 1978, the Kapiʻolani Hospital and the Kauikeolani Children’s Hospital merged to become Kapiolani Medical Center for Women & Children. (KMC)

Renovation and expansion began with construction of a new 17-floor parking structure that opened in 2013. A new five-story, 200,000 square-foot building is currently under construction and scheduled for completion in 2016. It will house an expanded Neonatal Intensive Care Unit (NICU) and Pediatric Intensive Care Unit (PICU).

The new building will also provide new space for the Rehabilitation Services Department and teaching space to train Hawaii’s future health care professionals in obstetrics and gynecology, pediatric and other specialty areas of care. It will include an auditorium and education and conference rooms. (KMC)

Charles John Wall

Charles John Wall was born in Dublin, Ireland, on December 23, 1827.  He married Elizabeth Evans (Miller) Wall; they had 10-children: Thomas E Wall; Emily Wall; Charles Wall; William Albert Wall; Henry Wall; Walter (Walt) Eugene Wall; Arthur Frederick Wall; Alford Wall; Ormand E Wall and Alice Wall

In 1880, the family came to Honolulu by way of California.  Wall (and some of his children) left some important legacies in Hawaiʻi.  Charles was an important nineteenth century Honolulu architect, some of the buildings he designed are still here; several have been lost, but not forgotten.

Charles J Wall participated, or led the design of ʻIolani Palace, Kaumakapili Church, Lunalilo Home and the Music Hall/Opera House.

ʻIolani Palace

The design and construction of the ʻIolani Palace took place from 1879 through 1882; three architects were involved: Thomas J Baker, Charles J Wall and Isaac Moore. The Baker design generally held in the final work.

A quarrel broke out between Baker, Samuel C Wilder (Minister of the Interior) and the Superintendent of Public Works.  Shortly after the cornerstone was laid on December 31, 1879; Baker apparently ended his connection with the Palace.

He was succeeded by Wall, who had recently arrived in the Islands and was “employed to make the detail drawings from the first architect’s plans.”

According to the March 31, 1880 Hawaiian Gazette, Wall had “skillfully modified and improved” some of the objectionable features of the original design.  (Peterson)  Wall was succeeded by Isaac Moore after about nine months.

ʻIolani Palace was the official residence of both King Kalākaua and Queen Lili‘uokalani. After the overthrow of the monarchy, ʻIolani Palace became the government headquarters for the Provisional Government, Republic, Territory and State of Hawai‘i.

During WWII, it served as the temporary headquarters for the military governor in charge of martial law in the Hawaiian Islands.  Government offices vacated the Palace in 1969 and moved to the newly constructed capitol building on land adjacent to the Palace grounds.

Kaumakapili Church

Starting in 1837, “the common Hawaiian folk of Honolulu” started petitioning Rev. Hiram Bingham, head of the Hawaiian Mission, to establish a second church or mission in Honolulu (Kawaiahaʻo being the first.)

It started as a thatched-roof adobe structure erected in 1839 on the corner of Smith and Beretania Streets.  The adobe building was torn down in 1881 to make way for a new brick edifice.

King Kalākaua took great interest in the church and wanted an imposing church structure with two steeples.  His argument was, “…that as a man has two arms, two eyes, two ears, two legs, therefore, a church ought to have two steeples.”

The cornerstone for the new church was laid on September 2, 1881 by Princess Liliʻuokalani (on her birthday.)  Seven years later the new building was completed.

It was an imposing landmark, first of its kind, and visible to arriving vessels and land travelers.  It was dedicated on Sunday, June 10, 1888.  In January, 1900, disaster struck.  The Chinatown fire engulfed the entire building leaving only the brick walls standing.

On May 7, 1910, the congregation broke ground for the third church building.  It was dedicated on June 25, 1911, the same day in which the 89th Annual Conference of the Hawaiian Evangelical Association (ʻAha Paeʻaina) was hosted by the church.

Lunalilo Home

The coronation of William Charles Lunalilo took place at Kawaiahaʻo Church in a simple ceremony on January 9, 1873. He was to reign as King for one year and twenty-five days, succumbing to pulmonary tuberculosis on February 3, 1874.

His estate included large landholdings on five major islands, consisting of 33 ahupuaʻa, nine ‘ili and more than a dozen home lots. His will established a perpetual trust under the administration of three trustees to be appointed by the justices of the Hawaiian Supreme Court.

Lunalilo was the first of the large landholding aliʻi to create a charitable trust for the benefit of his people.  The purpose of his trust was to build a home to accommodate the poor, destitute and infirm people of Hawaiian (aboriginal) blood or extraction, with preference given to older people.

In 1879 the land for the first Lunalilo Home was granted to the estate by the Hawaiian government and consisted of 21 acres in Kewalo, near the present Roosevelt High School.

The construction of the first Lunalilo Home at that site was paid for by the sale of estate lands. The Home was completed in 1883 to provide care for 53 residents. An adjoining 39 acres for pasture and dairy was conveyed by the legislative action to the Estate in 1888.

After 44 years, the Home in Kewalo (mauka) had deteriorated and became difficult and costly to maintain. The trustees located a new 20-acre site in Maunalua on the slopes of Koko Head.

Music Hall – Opera House

In 1881, a Music Hall was built across the street from ʻIolani Palace, where Ali‘i regularly joined the audiences at performances. Queen Lili‘uokalani is even said to have written her own opera.  (Ferrar)  It was built by the Hawaiian Music Hall Association.

The building was first called the Music Hall, but shortly after its transfer to new owners, the name was changed to the Royal Hawaiian Opera House.  (Daily Bulletin, February 12, 1895)

Despite its name, the Opera House was not primarily a venue for classical entertainment. Many of its bookings were melodramas and minstrel shows, two very popular forms of theater at the time.  Then, it was the first house to show moving pictures in Hawaiʻi.

The building was of brick 120 by 60 feet on the ground floor and walls forty feet high and twenty inches thick. The front door was ten feet wide, opening into a vestibule 16 by 27 feet. The seating capacity of the house was 671 persons. The stage was forty feet deep and provided with a complete set of scenery, traps and all necessary paraphernalia. (Hawaiian Star, February 12, 1895)

“Originally there were two (private) boxes. One on the right of the stage looking out was regarded as the property of the late King Kalākaua, who had subscribed liberally to the stock of the Association.  The box on the opposite side was owned by the present proprietors, Messrs. Irwin & Spreckels. About two years ago two boxes wore opened above those mentioned for letting to whomever first applied for thorn on any occasion.”  (Daily Bulletin, February 12, 1895)

Wall died at Honolulu on December 26, 1884.
