Two Wills, Two Outcomes

Prince Lunalilo was born on January 31, 1835 to High Chiefess Miriam ‘Auhea Kekauluohi (Kuhina Nui, or Premier of the Hawaiian Kingdom and niece of Kamehameha I) and High Chief Charles Kanaʻina.

Lunalilo’s grandparents were Kalaʻimamahu (half brother of Kamehameha I) and Kalākua (sister to Kaʻahumanu). His great grandfather was Keōuakupupailaninui (Keōua, father of Kamehameha I.)

Lunalilo was educated at the Chiefs’ Children’s School, and at age four, became one of its first students. He was known as a scholar, a poet and a student with amazing memory for detail.

From a very young age, he loved to write with favorite subjects in school being literature and music. He composed Hawai’i’s first national anthem, E Ola Ke Ali`i Akua, or God Save the King.

He also developed a sense of justice and love for people. These traits were recognized by the age of six in the unselfish and caring manner in which he interacted with his servants.

As a young man, he was courteous and intelligent, generous and friendly. His close friends affectionately called him “Prince Bill”. His native people called him ”Lokomaikaʻi”, meaning “generous or benevolent”.

When Lunalilo died in 1874, while he was king, he was the first of the large landholding aliʻi to create a charitable trust for the benefit of his people.

His estate included large landholdings on the five major islands, consisting of 33-ahupuaʻa, nine ʻili and more than a dozen home lots. His will, written in 1871, established a perpetual trust under the administration of three trustees to be appointed by the justices of the Hawaiian Supreme Court.

The purpose of the trust was to build a home to accommodate the poor, destitute and infirm people of Hawaiian (aboriginal) blood or extraction, with preference given to older people. The will charged the Trustees to sell all of the estate’s land to build and maintain the home.

His will states “all of the real estate of which I may die seized and possessed to three persons … to be held by them in trust for the following purposes, to wit …”

“… to sell and dispose of the said real estate to the best advantage at public or private sale and to invest the proceeds in some secure manner until the aggregate sum shall amount to $25,000, or until the sum realized by the said trustees shall with donations or contributions from other sources, amount to the said sum of $25,000.” (District Court Records)

“The will leaves the testator’s real estate to his Trustees in trust to sell the same at public or private sale and invest the same till the amount realized from such sale or by additions from other sources shall be $25,000 …”

“… and then directs that they shall expend the whole amount in the purchase of land and in the erection of a building or buildings on the Island of Oahu for specified eleemosynary purposes.” (Supreme Court Records)

His will notes, “Then I order the trustees to exceed the whole amount in the purchase of land and in the erection of a building or buildings on the Island of Oʻahu, of iron, stone, brick or other fireproof material, for the use and accommodation of poor, destitute and infirm people of Hawaiian blood or extraction, giving preference to old people.” (District Court Records)

According to the instructions in the will, the Estate trustees sold the land, built Lunalilo Home and invested the remaining proceeds in mortgages, securities and government bonds.

Unfortunately, those investments went sour, and today the Lunalilo estate has limited assets, other than Lunalilo Home in Hawaiʻi Kai and the land under it, and the trust must constantly raise funds to maintain the operation of the home. (Byrd)

Reportedly, Lunalilo left an estate even larger than the one left by Princess Bernice Pauahi Bishop, founder of Kamehameha Schools. However, the outcome of her estate has had a different ending.

High Chief Abner Pākī and his wife High Chiefess Laura Kōnia (Kamehameha III’s niece) had one child, a daughter, Bernice Pauahi Pākī (born December 19, 1831.)

When her cousin, Princess Ruth Keʻelikōlani, died, Keʻelikōlani’s will stated that she “give and bequeath forever to my beloved younger sister (cousin), Bernice Pauahi Bishop, all of my property, the real property and personal property from Hawaiʻi to Kauaʻi, all of said property to be hers (about 353,000 acres.)”

(Keʻelikōlani had previously inherited all of the substantial landholdings of the Kamehameha dynasty from her brother, Lot Kapuāiwa (King Kamehameha V.))

Pauahi died childless on October 16, 1884. Her will formed and funded the Kamehameha Schools; “I give, devise and bequeath all of the rest, residue and remainder of my estate real and personal … to erect and maintain in the Hawaiian Islands two schools, each for boarding and day scholars, one for boys and one for girls, to be known as, and called the Kamehameha Schools.”

Bernice Pauahi Bishop’s will (Clause 13) states her desire that her trustees “provide first and chiefly a good education in the common English branches, and also instruction in morals and in such useful knowledge as may tend to make good and industrious men and women”.

That same Clause gives the “trustees full power to make all such rules and regulations as they may deem necessary for the government of said schools and to regulate the admission of pupils, and the same to alter, amend and publish upon a vote of a majority of said trustees.”

She directed “that the teachers of said schools shall forever be persons of the Protestant religion, but I do not intend that the choice should be restricted to persons of any particular sect of Protestants.”

However, in order to support her vision, her will did not require her trustees to sell the land; rather, they can only sell “for the best interest” of the estate. Clause Seventeen notes, “I give unto the trustees … the most ample power to sell and dispose of any lands or other portion of my estate, and to exchange lands and otherwise dispose of the same … “

“I further direct that my said trustees shall not sell any real estate, cattle ranches, or other property, but to continue and manage the same, unless in their opinion a sale may be necessary for the establishment or maintenance of said schools, or for the best interest of my estate.”

Today, the Kamehameha Schools Bishop Estate has net assets of nearly $7-billion and annual operating revenue of $1.34-billion.

“Had Lunalilo directed its trustees, as Princess Pauahi Bishop did, to retain the land and sell it only as necessary to run the home for the aged, the Lunalilo Trust today would rival the Bishop Estate in its net asset value, and it would be able to assist many more than the approximately fifty elderly Hawaiians who now live in Lunalilo Home.” (Takabuki)

“Princess Pauahi was wise when she directed her trustees to retain the “ʻĀina,” her primary endowment, and sell it only when necessary for the Kamehameha Schools or the best interest of the trust. Real estate has been, and will continue to be, a sound, prudent, long-term investment.” (Takabuki)

This summary is intended to address one key differing statement in the respective wills. While each called for trustees selected by the Supreme Court (thereby not knowing who would eventually carry out its instruction,) Lunalilo instructed his trustees to sell his land; on the other hand, Pauahi gave her trustees that right, but only in the “best interest” of the trust.

Hawaiʻi National Anthem

The history of Hawaiʻi’s National Anthems generally starts in 1861. Before then, the kingdom of Hawaiʻi did not have its own anthem, but used the British royal anthem “God Save the King”.

The Hawaiian language newspaper, Ka Nūpepa Kū‘oko‘a, wishing to promote a Hawaiian national song sponsored an anthem writing contest in 1861. The rules specified four stanzas in the Hawaiian language, but still set to the tune of God Save the King.

Fifteen anonymous entries were submitted. In January of 1862, the judges chose an entry titled “E Ola ka Mō‘ī i ke Akua” as the winner. The composer was Prince William Lunalilo, age 27; his prize was $10.00.

His song was a faithful translation of “God Save The King” into Hawaiian, yet it fits the music of the British tune. Lunalilo’s new song was sung first on the birthday of Kamehameha IV.

He Mele Lahui Hawaiʻi (“The Song of the Hawaiian Nation”) (Liliʻuokalani)

King Kamehameha V wanted to replace the translated British anthem by a song with a truly Hawaiian background. At the request of King Kamehameha V, the new song “He Mele Lāhui Hawaiʻi” (“The Song of the Hawaiian Nation”) was composed in 1868 by Mrs. John Dominis (later known as Queen Liliʻuokalani.)

Liliʻuokalani’s memoir, Hawaiʻi’s Story by Hawaiʻi’s Queen, stated: “In the early years of the reign of Kamehameha V, he brought to my notice the fact that the Hawaiian people had no national air. Each nation, he said, but ours had its statement of patriotism and love of country in its own music; but we were using for that purpose on state occasions the time-honored British anthem, ‘God save the Queen.'” (Liliʻuokalani)

“This he desired me to supplant by one of my own composition. In one week’s time I notified the king that I had completed my task. The Princess Victoria had been the leader of the choir of the Kawaiahaʻo church; but upon her death, May 29, 1866 I assumed the leadership. It was in this building and by that choir that I first introduced the ‘Hawaiian National Anthem.’” (Liliʻuokalani)

“The king was present for the purpose of criticising my new composition of both words and music, and was liberal in his commendations to me on my success. He admired not only the beauty of the music, but spoke enthusiastically of the appropriate words, so well adapted to the air and to the purpose for which they were written.” (Liliʻuokalani)

The lyrics of this song praise the Hawaiian Islands. It asks the lord for blessing for the land, its people, chiefs and king. Liliʻuokalani was then the leader of the Kawaiahaʻo church choir, which introduced the new anthem in a public service.

Hawaiʻi Ponoʻī (“Hawaiʻi’s own”) (Kalākaua)

King David Kalākaua (brother of Liliʻuokalani) wrote the words to “Hymn to Kamehameha I” (Hawaiʻi Ponoʻī) in 1874 and the music was composed by Captain Henri Berger, then the king’s royal bandmaster.

Hawaiʻi Ponoʻī was one of the national anthems of the Republic of Hawaiʻi and the Kingdom of Hawaiʻi, having replaced Liliʻuokalani’s composition He Mele Lahui Hawaiʻi.

Hawaiʻi Ponoʻī was the adopted song of the Territory of Hawaiʻi; and later became the State song for the State of Hawaiʻi, by an act of the Hawaiʻi State Legislature in 1967:

“HRS-§5-10 State song. The song “Hawai‘i Pono‘i” is adopted, established, and designated as the official song of the State, to be effective for as long as the legislature of the State does not otherwise provide.”

Queen For A Day

The aliʻi attained high social rank in several ways: by heredity, by appointment to political office, by marriage or by right of conquest. The first was determined at birth, the others by the outcomes of war and political processes.

King Kamehameha I conquered most of the islands by late-1795 and negotiated a peaceful unification of the islands under single rule in 1810.  Before this, the Hawaiian Islands were ruled by a network of independent island kings (High Chiefs called Aliʻi Nui) through most of its history.

Queen Kaʻahumanu was Kamehameha’s favorite wife; but her role in leadership became more than that.  She was, at one time, arguably, the most powerful figure in the Hawaiian Islands, helping usher in a new era for the Hawaiian kingdom.

When Kamehameha died on May 8, 1819, the leadership was passed to his son, Liholiho, who would rule as Kamehameha II.  At that time, Kaʻahumanu created the office of Kuhina Nui and would rule as an equal with Liholiho.

Ka‘ahumanu assumed control of the business of government, including authority over land matters, the single most important issue for the Hawaiian nation for many generations to come.

The Kuhina Nui was a unique position in the administration of Hawaiian government and had no specific equivalent in western governments of the day. It has been described in general terms as “Prime Minister,” “Premier” and “Regent.”

The Kuhina Nui held equal authority to the king in all matters of government, including the distribution of land, negotiating treaties and other agreements, and dispensing justice.

Kamehameha III established Hawai‘i’s first constitution in 1840, where the office of Kuhina Nui was first codified.  The Kuhina Nui’s primary judicial responsibility over “life and death, condemnation and acquittal” became institutionalized in that constitution (1840.)  The Kuhina Nui was also given the duty of presiding, with the King, over the Supreme Court.

Article 45 of the 1852 Constitution of Hawaiian Kingdom stated: “Art. 45. All important business of the kingdom which the King chooses to transact in person, he may do, but not without the approbation of the Kuhina Nui. The King and Kuhina Nui shall have a negative on each other’s public acts.”

The Constitution of 1852 further clarified some of the office’s responsibilities, including its authority in the event of the King’s death or minority of the heir to the throne.  The office of Kuhina Nui functioned from 1819 to 1864, through the reigns of Kamehameha II, III, IV and V.

Kaʻahumanu was such a powerful person and Kuhina Nui that subsequent female Kuhina Nui adopted her name, Kīna‘u (Kaʻahumanu II) (1832-1839,) Kekāuluohi (Kaʻahumanu III) (1839-1845) and Victoria Kamāmalu (Kaʻahumanu IV) (1855-1863.)  (Keoni Ana (1845-1855) and Mataio Kekūanāo‘a (1863-1864) were the male Kuhina Nui.)

The Constitution (1852 – Article 47) further stated that the Kuhina Nui (Premier), in absence of a Monarch, would fill the vacant office.  “Whenever the throne shall become vacant by reason of the King’s death, or otherwise, and during the minority of any heir to the throne, the Kuhina Nui, for the time being, shall, during such vacancy or minority, perform all the duties incumbent on the King, and shall have and exercise all the powers, which by this Constitution are vested in the King.”

This situation occurred once, when Kuhina Nui Victoria Kamāmalu (Kaʻahumanu IV) assumed the powers of the monarchy – and, was conceptually “Queen” for a day – the first sole-ruling female of the Kingdom of Hawaiʻi.   Here’s how it happened.

On April 6, 1853, Alexander Liholiho was named successor to the office of the Constitutional Monarch by King Kamehameha III, in accordance with Article 25 of the Constitution of 1852. Article 25 provided that the “…successor (of the Throne) shall be the person whom the King and the House of Nobles shall appoint and publicly proclaim as such, during the King’s life…”

Alexander Liholiho succeeded Kamehameha III on December 15, 1854 (at the death of Kamehameha III) and served as Kamehameha IV.

Victoria Kamāmalu became Kuhina Nui in 1855 by appointment by her brother, Alexander Liholiho (Kamehameha IV.)  Kamehameha IV ruled for nine years; he died unexpectedly on November 30, 1863, without naming a successor.

Following the provisions of the Constitution, on November 30, 1863, Kuhina Nui Victoria Kamāmalu became the first female Head of State in Hawaiʻi (149-years ago, today.)

After consulting with the Privy Councilors, Kuhina Nui Victoria Kamāmalu proclaimed in front the Legislature:

“It having pleased Almighty God to close the earthly career of King Kamehameha IV, at a quarter past 9 o’clock this morning, I, as Kuhina Nui, by and with the advice of the Privy Council of State hereby proclaim Prince Lot Kamehameha, King of the Hawaiian Islands, under the style and title of Kamehameha V. God preserve the King!”

Kamehameha V had not named a successor to the throne before he died on December 11, 1872. Lunalilo, heir apparent to the throne, wanted his people to choose their next ruler in a democratic manner and requested a vote be held on New Year’s Day following the death of Kamehameha V.

He therefore noted, “Whereas, it is desirable that the wishes of the Hawaiian people be consulted as to a successor to the Throne, therefore, notwithstanding that according to the law of inheritance, I am the rightful heir to the Throne, in order to preserve peace, harmony and good order, I desire to submit the decision of my claim to the voice of the people.” (Lunalilo, December 16, 1872)

Prince David Kalākaua and others not in the Kamehameha lineage, chose to run against Prince Lunalilo.  The people on every island unanimously chose William Charles Lunalilo as King. (lunalilo-org)

At noon on January 8, 1873, the Legislature met, as required by law, in the Courthouse to cast their ballots of election of the next King.  Lunalilo won – the first elected King of Hawaiʻi (officially elected by the Legislative Assembly.)

Hale Ali‘i

When the seat of government was being established in Lāhainā in the 1830s, Hale Piula (iron roofed house,) a large two-story stone building, was built for Kamehameha III to serve as his royal palace.

But, by 1843, the decision was made to permanently place a palace in Honolulu; Hale Piula was then used as a courthouse, until it was destroyed by wind in 1858 – its stones were used to rebuild a courthouse on Wharf Street.

In Honolulu, Kekūanāo‘a (father of two kings, Kamehameha IV and V) was building a house for his daughter (Princess Victoria Kamāmalu.)

The original one story coral block and wooden building called Hanailoia was built in July 1844 on the grounds of the present ‘Iolani Palace.

But, in 1845 Kamehameha III took possession of it as his Palace; from then on, Honolulu remained the official seat of government in Hawai‘i.

At the time when Kekūanāo‘a erected the old Palace, the grounds were not so spacious as they are at present.  On the western corner was Kekūanaō‘a’s house, which he had named Hali‘imaile.

Kekauluohi, a premier, erected her house in the vicinity.  When John Young was premier, he built and lived in Kīna‘u Hale.  Also, on the premises was Pohukaina.

The site of the Palace was once a section of the important heiau (temple,) Ka‘ahaimauli; other heiau were also in the vicinity of the Palace, including Kanela‘au and Mana.

The Palace was used mainly of official events and the structure had mainly offices and reception areas, since smaller buildings on the grounds served as residences for the rulers and their court; it was only one-third the floor area of the present Palace.

Kamehameha III built a home next door (on the western side of the present grounds, near the Kīna‘u gate, opening onto Richards Street;) he called the house “Hoihoikea,” (two authors spell it this way – it may have been spelled Hoihoiea) in honor of his restoration after the Paulet Affair of 1843. (In 1843, Paulet had raised the British flag and issued a proclamation annexing Hawai‘i to the British Crown.  This event became known as the Paulet Affair.  Queen Victoria sent Rear Admiral Richard Thomas to restore the Hawaiian Kingdom.  That day is now referred to as Ka La Hoʻihoʻi Ea, Sovereignty Restoration Day.)

“Hoihoikea” was a large, old-fashioned, livable cottage erected on the grounds a little to the west and mauka side of the old Palace.  This served as home to Kamehameha III, Kamehameha IV and Kamehameha V: the Palace being used principally for state purposes. (Taylor)

The palace building was named Hale Ali‘i meaning (House of the Chiefs.)

During the reign of Kamehameha V, cabinet councils were frequently held there.  This was where the council called the Constitutional Convention, the result of which was the abolition of the constitution of 1852 and the creation of a new one.

Hale Ali‘i was renamed ‘Iolani in 1863, at the request of King Kamehameha V (Lot Kapuāiwa.)  The name “‘Iolani” was chosen by King Kamehameha V to honor his deceased brother, the former king, Kamehameha IV (Alexander Liholiho ‘Iolani.)

“‘Io” is the Hawaiian hawk, a bird that flies higher than all the rest, and “lani” denotes heavenly, royal or exalted.

The Palace served as the official state structure for five Kings: Kamehameha III, Kamehameha IV, Kamehameha V, Lunalilo and the first part of Kalākaua’s reign.

Theodore Heuck, who had earlier designed the new Mausoleum, designed a building called ‘Iolani Barracks, completed in 1871, to house the royal guards. Over time the various other houses on the grounds were removed and replaced with grass lawns.

Although the old palace was demolished in 1874, the name ʻIolani Palace was retained for the building that stands today.

The construction of the present ‘Iolani Palace began in 1879 and in 1882 ‘Iolani Palace was completed and furnished.

Hawaiian Dynasties

The Kamehameha Dynasty ruled for nearly a century from the late-1700s to the late-1800s, while the Kalākaua Dynasty ruled from 1874 to 1893.

Kamehameha Dynasty

Kamehameha I, Paiʻea, Kamehameha the Great (1758-1819)
Born in North Kohala on the Big Island, Kamehameha united all the major islands under one rule in 1810.

The king traded with foreign ships arriving in the islands and enlisted some of the foreigners into his service. During his reign, the export of sandalwood to the Orient brought about the ability for island chiefs to purchase merchandise from abroad.

Kamehameha II, Liholiho – (1796-1824)
The son of Kamehameha and his sacred wife Keōpūolani, Liholiho overthrew the ancient kapu system by allowing men and women of the court to eat at the same table. At the same time, he announced that the heiau (temples) should be destroyed with all the old idols.

Believing like his father that the islands were under the protection of Great Britain, Liholiho and his favorite wife Kamamalu traveled to England in May of 1824, where they were received by the government of King George IV. However, measles afflicted the royal party and Kamāmalu died on July 8 followed by Liholiho on July 14, 1824.

Kamehameha III, Kauikeaouli (1813-1854)
The younger brother of Liholiho had the longest reign in Hawaiian history. He was 10 years old when he was proclaimed king in 1825 under a regency with Ka‘ahumanu, his father’s favorite queen, as joint ruler.

Realizing the need for written laws to control growing problems brought about by increasing numbers of foreigners settling in the kingdom, the declaration of rights, called the Hawaiian Magna Charta, was issued on June 7, 1839. The rights of residents were repeated in the Constitution of 1840.

The Great Mahele (division), the first legal basis for land ownership in the kingdom, was enacted and divided the land between the king, his chiefs and others.

Kamehameha IV, Alexander Liholiho (1834-1863)
The nephew of Kauikeaouli, Alexander Liholiho was the son of Kekūanāoʻa and his wife Kīna‘u, the grandson of Kamehameha I, younger brother of Lot Kapuāiwa and elder brother of Victoria Kamāmalu.

He ascended to the throne after the death of his uncle in December of 1854. On June 19, 1856, he married Emma Rooke.

Concerned about the toll that foreign diseases were taking on his subjects, the king signed a law on April 20, 1859 that established a hospital in Honolulu for sick and destitute Hawaiians. He and Emma personally solicited funds to erect Queen’s Hospital, named in honor of Emma.

Kamehameha V, Lot Kapuāiwa (1830-1872)
Four years older than his brother Kamehameha IV, Lot would also rule for just nine years. In 1864, when it appeared that a new constitution could not be agreed upon, he declared that the Constitution of 1852 be replaced by one he had written himself.

Known as “the bachelor king,” Lot Kamehameha did not name a successor, which led to the invoking of the constitutional provision for electing kings of Hawai`i.

William Charles Lunalilo (1835-1874)
The grandson of a half-brother of Kamehameha I, Lunalilo was the son of Charles Kanaina and Kekauluohi, a sister of Kīnaʻu.

He defeated David Kalākaua in 1873 to become the first king to be elected (therefore, technically, not a part of the Kamehameha Dynasty, although he was related.) He offered many amendments to the Constitution of 1864, such as abolishing the property qualifications for voting.

Lunalilo died of tuberculosis on February 3, 1874, a little more than a year after his election. He became the first Hawaiian to leave his property to a work of charity, creating the Lunalilo Home, which accommodates elderly Hawaiians who are poor, destitute and infirm.

Kalākaua Dynasty

David Kalākaua (1836-1891)
After the death of Lunalilo, Kalākaua (married to Kapiʻolani) ran against and defeated the queen dowager, Emma. Kalākaua was the first king in history to visit the United States.

“The Merry Monarch” was fond of old Hawaiian customs, and he attempted to restore the people’s lost heritage – such actions gave rise to anti-monarchy movements, such as the Reform Party.

In 1887, Kalākaua signed the “Bayonet Constitution,” (signed under threat of an armed uprising) that stripped the king of most of his power and gave foreigners the right to vote. Kalākaua died while on a trip to San Francisco on January 20, 1891, leaving his younger sister Liliuokalani to ascend the throne.

Queen Lili‘uokalani, Lydia Kamakaʻeha Pākī (1839-1917)
Liliʻuokalani (married to John Owen Dominis and living at his mother’s home, Washington Place) inherited the throne from her brother, King Kalākaua, on January 29, 1891.

Two years later, a group composed of Hawaiian Nationals, Americans and Europeans formed a Committee of Safety seeking to overthrow the Hawaiian Kingdom, depose the Queen and seek annexation to the United States; the Queen was deposed on January 17, 1893.

Queen Lili‘uokalani flew the US flag over her personal residence, Washington Place, in 1917 to mourn and honor Hawaiians killed in World War I.
